This Community is owned and operated by Rise As We Are CIC (otherwise referred to as ”we”, “our” or ”us”), a Community Interest Company (CIC) that is registered in England and Wales with the company number 16572786 and the registered office address of 2 Hawthorn Close, Old Dalby, Melton Mowbray, Leicestershire, LE14 3LN, UK.
Please read these terms carefully before using our Community. Registering with our Community indicates that you, the customer (“you”), accept these terms. If you do not accept these terms, do not register with, access or use our Community.
Any purchase of Community membership and any purchase of Services you make via our Community or our website, including our workshops, courses, mentoring and coaching consultations, will be governed by our Terms and Conditions of Sale as displayed on our website.
Our online Community platform is owned and hosted by Heartbeat Chat Inc ("Heartbeat"). Rise As We Are CIC own and operate our Community on the Heartbeat platform. We always try to ensure that our Community is always available for you. However, full technical responsibility of the availability and functionality of our Community rests with Heartbeat Chat Inc. In the event that our Community is unavailable at any time and for any period (for whatever reason) we shall not be liable.
Our Community operates as a members-only online Community for adults. All members must be eighteen (18) years old or above. Access to our Community will be granted once you have completed your membership registration and submitted your first monthly subscription payment. Our online Community will be available for you to use at any time and on any day (subject to the availability of the Community host platform provided by Heartbeat Chat Inc), until such time that you cancel your membership.
We reserve the right to remove access to our Community in respect of anyone who does not comply with the terms set out herein.
To join, access and participate in our Community you will first need to register with Heartbeat. Heartbeat only requires your email address to complete this part of the process. Each registration is for a single user only. We do not permit you to share your login details with any other person nor with multiple users on a network. Responsibility for the security of your login details rests with you.
Once completed, Heartbeat will then direct you to their payment page where you will be required to provide your debit/credit card details and submit your monthly subscription payment to gain access to our Community. Our payment processor, Stripe LLC, will process your payment on our behalf.
Upon completion of your payment, you will then be required to create your own ‘member profile’. Your ‘member profile’ provides a means of describing yourself to other Community members and is useful for identifying you in discussions and events, and when developing friendships and support networks within our Community. Options are made available to you should you wish to protect your anonymity.
Your profile picture: This is required. You are free to upload an image of yourself or an image of your choosing;
Your name: This is required. You are free to use your real name (first or full name) or a username of your choosing;
Your location: This is required. You will need to select your general location of residence from the list provided (town or city and country);
Your member bio: This is optional. You may provide some limited background information describing yourself to other Community members, such as your age, neuro-type, pronouns, job title, interests and hobbies, skills, talents, achievements, or anything else you would like to share about yourself with other Community members.
You are given access to add, edit and remove the information that you initially submit for the creation of your member profile by visiting your ‘Account Settings’ within the Community.
You are prohibited from using any words, phrases or images in your member profile that are defamatory, obscene, offensive or similar. We reserve the right to remove any material from your member profile that we consider inappropriate or unsuitable.
Your personal information that you provide to us during your Community registration will be dealt with in line with our Community Privacy Policy.
Unless stated otherwise, the intellectual property rights and copyrights for all material displayed within our Community (and contained in the online webinars, events, courses and resource materials accessed via our Community or our website) are owned by us or our licensors. You may download and print extracts from our Community (or from the online webinars, events, courses and resources materials accessed through our Community or our website) for your own personal, non-commercial purposes. You should not use any extracts from our Community for any other purposes. Any rights not expressly granted in these terms and conditions are reserved.
No part of our Community may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission. Any rights not expressly granted in these terms are reserved.
Other than personally identifiable information, which is covered under our Community Privacy Policy, any material you post or share to our Community shall be considered non-confidential and non-proprietary. We shall have no obligations with respect to such material. You are free to edit or remove any content that you post or share within the Community. You must have obtained all necessary licences and/or approvals before submitting any commercially-owned information or content.
We will not be responsible, or liable to any third party, for the content or accuracy of any content, or infringements of any copyrighted content, posted or uploaded by you or any other user of our Community.
The views expressed by Community members anywhere within our Community may not represent the views or values of Rise As We Are CIC.
You are prohibited from posting or transmitting to or from our Community any material that is threatening, defamatory, obscene, or similar. We reserve the right to remove any material from our Community that we consider inappropriate, unsuitable or illegal.
We shall fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting illegal material.
Safeguarding the wellbeing of our Community members is our highest priority. As such we reserve the right to remove access to our Community in respect of anyone who does not comply with our Community Code of Conduct and our Community Anti-Harassment Statement. Both of these documents are made available for viewing in the Community Resources within the ‘Community Help’ section.
All members of the Community are able to report any violations of our Code of Conduct and Anti-Harassment Statement by other members and Community staff to our Community Administrators and Moderators. We will investigate and act accordingly to all reports of such violations.
Links to third party websites on our Community are provided solely for your convenience. If you use these links, you leave our Community in order to access these third party websites. We have initially reviewed all of these third party websites to determine their credibility and authority on their purpose or relevant topic, but we do not control and are not responsible for these websites or their content or availability. We therefore do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to by our Community, you do so entirely at your own risk.
You may cancel your Community membership at any time by selecting the ‘Leave This Community’ option on your personal ‘Account Settings' page within our Community. Your future subscription payments will cease to be debited from your nominated payment method from the date and time of your membership cancellation.
In accordance with our Terms and Conditions of Sale, no refunds can be made for Community membership subscriptions once you have created your Community member account, regardless of whether or not you have accessed and used the Community platform during the current or any previous month that your monthly subscription payment has entitled you to access of our Community.
For full details on how your personal information will be handled, processed and used by us in relation to your registration, payment, access and use of our Community, please refer to our Community Privacy Policy which is available to view on our website and in the Community Resources within the ‘Community Help’ section.
If you purchase and participate in our other Services which occur outside of our Community, such as our workshops, mentoring and coaching consultations, your personal information will be handled, processed and used in accordance with our organisation’s full Privacy Notice which is available to view on our website.
Save to the extent permitted by law, we (and any of our directors, employees, sub-contractors or agents of any of them) exclude all liability and responsibility (including without limitation in respect of negligence) from any amount or kind of loss or damage arising out of or in connection with your use of our Community.
We do not exclude or attempt to limit in any way our liability:
For personal injury or death resulting from our negligence;
For any matter for which it would be illegal for us to exclude or to attempt to exclude our liability; or
For fraud or fraudulent misrepresentation.
Subject to the exclusions/limitations set out above, we shall not be liable to you for any indirect or consequential loss or damage of any nature whatsoever arising and whether caused in tort (including negligence), breach of contract or otherwise (even if foreseeable), any loss of income or revenue, loss of business, loss of profit of contracts, loss of anticipated savings, wasted third party costs, and/or loss of data, management or office time.
We will perform and deliver our own content within our Community with reasonable care and skill. We do not give any other representation, warranty or undertaking in relation to our content. Any representation, condition or warranty which might be implied or incorporated into these terms by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that our Community and our own content, or any content provided by Community members, within our Community, is suitable for your purposes and do not guarantee any specific results from participating in any aspect of our Community.
We have the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions in force at the time that you access our Community. Any amendments to these terms and conditions will be announced within our Community at the time they are made.
If any provision within these terms and conditions is held by any competent authority to be invalid or unenforceable (in whole or in part) the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected.
These terms and conditions (including in relation to any non-contractual obligations) shall be governed by and interpreted in accordance with English law and subject to the exclusive jurisdiction of the English courts.
